Unstyled® by Ashitha reserves the right to modify these terms at any time at our sole discretion. Your continued use of our website following the posting of changes constitutes your acceptance of such changes.

 

Services

 

Unstyled® by Ashitha provides various services including but not limited to Colour Analysis, Bridal Styling, and Personal Styling. The specific terms and conditions for each service are as stated in the respective service agreements. By purchasing or using any of our services, you agree to comply with the terms of the respective service agreement.

 All services are provided "as is", without warranty of any kind, either express or implied. While we endeavour to provide the best possible service, we cannot guarantee 100% satisfaction due to the subjective nature of styling and the numerous variables involved in colour analysis.

The reports generated as part of our colour analysis and personal styling services are intended for your personal use only. These reports are tailored to your specific needs and preferences, and their content is not to be shared or used for any commercial purposes without our prior written consent.

There are no physical products shipped as part of our services. 

 

Payment and Refund Policy

 

Full payment is required before the commencement of any services. All prices are subject to change, and we will notify you of any changes in pricing before finalising your order. A full refund will be provided if the client cancels the service within 2 days, provided that no photos, measurements, or assessments have been submitted. Once the necessary assessment information is received and the analysis process has started, refunds cannot be processed. Link to Cancellations & Refund Policy

 

Client Responsibilities

 

The client is responsible for providing accurate information required for the service, including measurements, photos, and other details. The service cannot commence until all required information is received. We are not responsible for any dissatisfaction a client may have with clothing or accessories purchased based on our advice. Any issues should be addressed directly with the respective vendor.

 

Confidentiality

Both parties agree to keep the information designated as “confidential information” confidential and not disclose it to any third party without the prior written consent of the disclosing party, except as may be necessary in the course of performing obligations under these terms and conditions.

The confidentiality obligations do not apply to information that:

1. 1. Is already in the public domain at the time of disclosure;

   2. Was known to the receiving party before disclosure;

   3. Is disclosed by a third party who is not under any obligation of confidentiality;

   4. Is independently developed by the receiving party; or

   5. Must be disclosed by law or regulation, provided that the disclosing party is notified in advance to allow it to seek protective measures.

The confidentiality obligations will survive after the termination of these terms and conditions.

All materials provided as part of the service, including look books, colour guides, and other digital materials, are the intellectual property of Unstyled® by Ashitha and may not be reproduced or distributed without our written permission.

Any digital products you receive as part of our services rendered to you are provided to you solely for your personal use. This means you may refer to the them and utilize them for your personal colour analysis needs and not for any other purposes. You are strictly prohibited from reselling, distributing, or sharing such digital products with others for any commercial purpose.

We respect the privacy of our clients. All client information will be kept confidential and will not be shared with third parties. Your use of our website is also governed by our Privacy Policy. Please review our Privacy Policy carefully.

These terms and conditions shall be governed by and construed in accordance with the laws of India.

Dispute Resolution Clause

In the event of any dispute arising out of or in connection with these terms and conditions, the parties shall first attempt to resolve the dispute through amicable discussions between them failing which the parties agree to refer the dispute to mediation at the District Mediation Centre, Thodupuzha. The mediation shall be conducted in accordance with the applicable mediation rules and procedures of the Centre. The parties shall participate in good faith and attempt to resolve the dispute through mediation.

Subject to the above, any dispute that remains unresolved after mediation shall be subject to the jurisdiction of the High Court of Ernakulam, Kerala. Both parties hereby submit to the exclusive jurisdiction of these courts and waive any objections to any other court.

Changes to this Terms & Conditions

We may update this combined Terms & Conditions  from time to time. The updated version will be indicated by an updated "Revised" date, and the updated version will be effective as soon as it is accessible.
